The Spectrom Products Inc. Canada Inc. mobile message service (the "Service") is operated by Spectrom Products Inc. Canada Inc. (“Spectrom Products Inc. Canada Inc.”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Spectrom Products Inc. Canada Inc.’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Spectrom Products Inc. Canada Inc. through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include specials, promotions, sales, abandoned cart, discounts, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Spectrom Products Inc. Canada Inc.. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18774455109 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Spectrom Products Inc. Canada Inc. mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Spectrom Products Inc.’s trademarks and trade dress may not be used in connection with any product or service that is not Spectrom Products Inc.’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Spectrom Products Inc.. All other trademarks not owned by Spectrom Products Inc. that appear in the spectrom.ca Services are the property of their respective owners, who may or may not be connected to, or sponsored by Spectrom Products Inc.

 

 

License & Access

Subject to your compliance with these Conditions of Use and your payment of any applicable fees, spectrom.ca or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of spectrom.ca Services. This license does not include any resale or commercial use of spectrom.ca Services or their contents; any collection and use of any product listings, descriptions, or prices; any derivative use of spectrom.ca Services or their contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data-gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use are reserved and retained by Spectrom Products Inc. or its licensors, suppliers, publishers, rightsholders, or other content providers. Either spectrom.ca Services, or any part of spectrom.ca Services, may NOT be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Spectrom Products Inc. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of spectrom.ca without express written consent. You may not use any meta tags or any other “hidden text” utilizing Spectrom Products Inc.’s name or trademarks without the express written consent of Spectrom Products Inc.  You may not misuse spectrom.ca Services. You may use spectrom.ca Services only as permitted by law. The licenses granted by Spectrom Products Inc. will terminate if you do not comply with these Conditions of Use.

 

Your Account

If you use spectrom.ca Services, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under the age of majority in your state or province of residence, you may use the spectrom.ca Services only with the involvement of a parent or guardian. Spectrom Products Inc. reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

 

Communications & Other Content

Visitors may submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. If you do submit material, and unless Spectrom Products Inc. indicates otherwise, you grant Spectrom Products Inc. nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, produce, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, communicate to the public by telecommunications and display such content throughout the world in any media. You grant Spectrom Products Inc. the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Spectrom Products Inc. for all claims resulting from content you supply.

 

Risk of Loss

Risk of loss and title for items purchased from Spectrom Products Inc. pass to you upon delivery to the carrier.

 

Returns, Refunds, Exchanges & Title

Spectrom Products Inc. does not take title to returned items until the item arrives at Spectrom Products Inc.’s Distribution Centre. At Spectrom Products Inc.’s discretion, a refund may be issued without requiring a return. In this situation, spectrom.ca does not take title to the refunded item. Product Availability

Spectrom Products Inc. reserves the right without prior notice to discontinue or change specifications on products and services offered on this website without incurring any obligations.

 

Product Descriptions

spectrom.ca attempts to be as accurate as possible. However, Spectrom Products Inc. does not warrant that product descriptions or other content of spectrom.ca is always without error, accurate, complete, reliable or current. If a product offered by Spectrom Products Inc. is not as described, your sole remedy is to return it in an unused condition, but we ask you contact our customer service department first.

 

Product Colours

spectrom.ca does its best to display product colours shown on this website as accurately as possible. However, because the colours you see depend on your monitor, Spectrom Products Inc. cannot guarantee that your monitor’s display of any colour is accurate. Spectrom Products Inc. will not be held responsible for any discrepancies between the colour displayed for any given product on spectrom.ca and the actual perceived colour for this product itself.

 

Product Pricing

Spectrom Products Inc. reserves the right to modify retail prices at any time and without prior notice. All prices indicated exclude taxes, delivery (where applicable) and assembly. With respect to items sold by spectrom.ca, Spectrom Products Inc. cannot confirm the price of an item until you order. Despite Spectrom Products Inc.’s best efforts, a small number of the items in print by Spectrom Products Inc. may be mispriced. If an item’s correct price is higher or lower than the spectrom.ca stated price, Spectrom Products Inc. will, at its discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Applicable Law & Disputes

(Not applicable to Québec consumers) Any dispute or claim relating in any way to your use of spectrom.ca Services, or to any products or services sold or distributed by Spectrom Products Inc. or through spectrom.ca Services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.

Spectrom Products Inc. and you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration Spectrom Products Inc. and you each waive any right to a jury trial. Spectrom Products Inc. and you also both agree that you or Spectrom Products Inc. may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

 

Site Policies, Modification, and Severability

Spectrom Products Inc. reserves the right to make changes to the Spectrom Products Inc. website, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
